Terms of sale of digital content

These terms govern the purchase and use of digital products available at pinksand.pl/przewodniki/en: the PDF e-book, Premium access in the Crete Guide app, and the bundle combining both products. This document constitutes terms and conditions within the meaning of Article 8 of the Polish Consumer Rights Act for distance contracts.

§1. Sellers and contact

The sellers are Anna Łacińska and Tomasz Łaciński, operating under the Pink Sand Crete brand.

Sales and provision of services covered by these terms (e-book, Premium access in the Crete Guide app, and bundle) are carried out on their behalf. Contact: info@pinksand.pl.

Three purchase options are available at pinksand.pl/przewodniki/en:

Current prices for each option are shown on the offer page and in the Stripe checkout process, in Polish złoty (PLN). Only the provisions of these terms relating to the purchased product (or both, in the case of a bundle) apply.

§4. Contract formation and payment

The contract is concluded when payment is successfully completed via Stripe (Payment Link). Payment processing is provided by Stripe Payments Europe, Ltd. Card data is processed solely by Stripe — the Seller does not store it.

By purchasing, you confirm that the data provided (including name and email address) is accurate and that you have read these terms and the GDPR information clause.

§5. E-book licence — scope and restrictions

This section applies when purchasing an e-book or bundle. The Buyer acquires a personal, non-exclusive, non-transferable licence for their own use of the purchased e-book copy. The licence covers:

§6. Personalisation of copies

When purchasing an e-book or bundle, the e-book is delivered in a personalised version. Each PDF page includes a mark containing the Buyer's name and email address provided at purchase (e.g. “This copy was purchased by: …”). Personalisation serves to identify the copy, protect copyright, and perform the contract. Details of data processing are described in the GDPR clause.

§7. E-book delivery

When purchasing an e-book or bundle, the PDF file is sent automatically to the email address provided in the Stripe checkout, usually within a few minutes of payment confirmation. Delivery is electronic, as a PDF attachment or download link (depending on the current system configuration).

§8. Right of withdrawal

Under Article 38(13) of the Polish Consumer Rights Act, the right of withdrawal from a distance contract does not apply to contracts for the supply of digital content not supplied on a tangible medium if performance has begun with the consumer's express consent before the withdrawal period expired and after the consumer was informed about losing the right of withdrawal.

By placing an order for an e-book, Premium access, or bundle, you request immediate access to the content after payment (sending the PDF to your email and/or activating access in the app). You acknowledge that for this reason you do not have a 14-day right of withdrawal — on the terms described above.

§9. Premium access in the Crete Guide app

This section applies when purchasing Premium access or a bundle. After payment confirmation, the Buyer receives the right to use Premium content in the Crete Guide app, assigned to the user account logged in with the same email address used for Stripe payment.

Premium access is a one-time service providing access to Premium content in the Crete Guide app as available at the time of purchase and to any updates to that content provided by the Seller during the relevant tourist season (1 March to 30 November of the calendar year in which the purchase was made).

The Seller makes every effort to keep the app available and functional. The Buyer acknowledges that access to content is limited by the technical support period of the app.

The Seller guarantees availability of Premium content for at least 12 months from the date of purchase. After that period, the Seller may limit access to part or all of the content, in particular if technical support ends or the app is withdrawn from the market; this does not constitute non-performance of the contract.

Content in the app is for information and educational purposes; use of routes is at the Buyer's own responsibility.

§10. E-book + Premium bundle

When purchasing a bundle, the Buyer receives the services described in §§5–7 (e-book) and §9 (Premium access) simultaneously. The bundle price covers both elements; the bundle cannot be “split” into separate transactions after payment.

§11. Copyright

The e-book and content in the Crete Guide app are works protected by copyright. The Buyer does not acquire proprietary rights to the works — only the licence specified in these terms. Any infringement, including unauthorised sharing of a personalised file, may result in a demand to cease infringement, removal of content from circulation, and claims under general rules, including for copyright infringement and breach of licence terms.

§12. Complaints

If something went wrong — write to us at info@pinksand.pl. Please include the email used for purchase, approximate payment date, and a brief description. We handle each case individually — we want you to enjoy the e-book and app without worry.

We usually respond within a few business days, no later than 14 business days from receiving your message. Consumers may also use out-of-court dispute resolution, including the EU ODR platform: ec.europa.eu/consumers/odr.

§13. Changes to these terms

The Seller may amend these terms for important reasons (changes in law, offer, or delivery technology). Contracts concluded before a change are governed by the version in force at the time of purchase. The current version is published at pinksand.pl/przewodniki/en/regulamin.html.

§14. Final provisions

Matters not regulated herein are governed by Polish law, in particular the Consumer Rights Act, the Copyright Act, and the Civil Code. Disputes with consumers are resolved by courts with jurisdiction under generally applicable rules.
